These Terms of Use (hereinafter "Terms" or "Conditions") govern the use of the Skyden mobile application (hereinafter "the Application", "Skyden" or "the Service") and all associated services. Skyden refers to the digital pilot logbook application and all associated services, features and content. User or You refers to any individual using the Application. Publisher or We refers to the publisher of the Application, operating in France. By accessing, downloading or using Skyden, you expressly and unreservedly accept these Terms. If you do not accept these Terms, you must immediately cease using the Application.
Service Description
Skyden is a digital pilot logbook mobile application designed for aircraft pilots. It allows: recording and managing flights, automatic calculation of flight time totals, data synchronization across multiple devices, export and backup of flight data, tracking the validity of qualifications and licenses. The Application functions in offline mode with optional cloud synchronization.
Access conditions
3.1 Minimum age: The use of Skyden is reserved for persons aged at least 16 years. 3.2 Registration: The use of the Application may require the creation of a user account. You undertake to provide accurate, complete and up-to-date information, and to maintain the confidentiality of your login credentials.
Subscriptions and Pricing
4.1 Subscription options: Skyden offers the following options: - Annual subscription: €79.99 per year. - Lifetime license: €299.99 (one-time payment) providing access for as long as we commercially operate Skyden, with no recurring fees. If the service is permanently discontinued, access will end; no additional amounts will be owed. 4.2 Free trial period: New users benefit from a 14-day free trial of premium features. 4.3 Automatic renewal: Annual subscriptions renew automatically unless automatic renewal is disabled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. 4.4 Subscription management: You can manage your subscription and disable automatic renewal by accessing your App Store account settings after purchase. Subscriptions cannot be cancelled during the active subscription period. 4.5 Pricing: Prices may vary by location and are subject to change. Current pricing is displayed in the App Store. 4.6 Lifetime license specific conditions: We maintain your access for as long as Skyden operates the service. If we decide to permanently discontinue Skyden, we will inform you when reasonably possible, with a minimum notice period of 6 months. At the end of that period, access will be closed without prorated refund, as the one-time purchase will have been fully consumed. 4.7 Right of withdrawal: In accordance with Articles L221-18 et seq. of the French Consumer Code, you have a 14-day right of withdrawal for any distance purchase. This right no longer applies if you request immediate access to the digital features (including the Lifetime license) and expressly acknowledge waiving your right of withdrawal before the legal period expires. 4.8 Refunds: Refunds are processed according to Apple's App Store refund policy.
Use of the Service
5.1 Authorized use: Skyden is intended exclusively for personal use as a pilot logbook. You undertake to use the Application in accordance with its intended purpose, to enter only flights actually performed, to comply with all applicable laws and regulations, and not to infringe on the rights of third parties. 5.2 Prohibited uses: It is strictly prohibited to enter fictitious or non-performed flights, use the Application for illegal or fraudulent purposes, attempt to circumvent security measures, reverse engineer the software, transmit viruses or malicious code, or use the Application in a manner that would impair its operation. 5.3 Suspension or termination: In case of violation of these Terms, we reserve the right to suspend or terminate your access to the Service, without prior notice or compensation.
Intellectual Property
The Skyden Application, including its source code, interface, features and content, is protected by intellectual property rights. Any unauthorized reproduction, representation, modification or distribution is strictly prohibited. You retain ownership of the data you enter into the Application. By using Skyden, you grant us a limited license to process this data in the context of providing the Service.
Personal Data and Backup
7.1 Personal data: The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms. 7.2 Data backup: You are solely responsible for backing up your flight data; we recommend performing regular exports even though we carry out technical backups. 7.3 Retention in case of inactivity: If you stop using Skyden or your subscription ends without requesting erasure, we retain your flight logs for up to 10 years on the basis of our legitimate interest, so that you can reactivate your account and recover your professional history. 7.4 Account deletion: When you delete your account or request erasure, all your data (including backups) is removed from our servers without undue delay. After 10 years of inactivity without a request from you, any remaining data is also automatically deleted.
Liability and Limitations
8.1 Limitation of liability: The Skyden Application is provided as is. We exclude any warranty regarding the accuracy, completeness or reliability of the data, the absence of interruption or error in operation, or the suitability of the Service to your specific needs. 8.2 Aviation liability exclusion - IMPORTANT FOR PILOTS: We disclaim any liability regarding the use of flight data for regulatory, certification or legal purposes. It is your responsibility to verify that your digital logbook complies with the requirements of your civil aviation authority (EASA for Europe, FAA for the United States, etc.). We do not guarantee the acceptance of your data by authorities, examiners or employers. In case of audit or inspection, you are solely responsible for the presentation and justification of your flight data. 8.3 Use at your own risk: The use of the Application is at your own risk. We cannot be held responsible for any direct or indirect damage resulting from the use or inability to use the Service.
Termination
9.1 Termination by user: You can terminate your subscription at any time via the App Store settings. The termination will take effect at the end of the current billing period. 9.2 Termination by publisher: We may terminate your access to the Service in case of violation of these Terms, after formal notice that has remained without effect. 9.3 Effects of termination: Upon termination, your access to premium features will be suspended, your data will remain accessible in read-only mode, and no refund will be made for the unused period. 9.4 Lifetime license: The one-time purchase is not subject to renewal and remains valid as long as we operate Skyden in accordance with Article 4.6. If the service is discontinued after the required notice period, access ends without additional refund.
Applicable Law and Jurisdiction
These Terms are governed by French law. Any dispute relating to their interpretation or execution shall be brought before the competent French courts. Before any legal recourse, we undertake to seek an amicable solution. You may also resort to a mediation procedure or contact the Commission for Evaluation and Control of Consumer Mediation.
General Provisions
11.1 Modification of Terms: We reserve the right to modify these Terms at any time. Modifications will take effect upon their publication in the Application. In case of substantial modification, you will be informed by notification in the Application. 11.2 Severability: If any provision of these Terms were to be declared null or unenforceable, the other provisions would remain fully in force. 11.3 Waiver: Failure to exercise a right provided for in these Terms does not constitute a waiver of that right.
